1. Acceptance of Terms
By creating an account or using the MailGantry API and dashboard (the "Service") provided by The SaaSy People Ltd., you agree to be bound by these Terms of Service ("Terms").
2. Description of Service
MailGantry is a transactional email and SMS delivery platform. It allows users to:
Manage email templates via MJML or a GUI editor.Send emails and SMS via API or dashboard triggers.
Track delivery and engagement metrics.
Verify sending domains via DNS records.
3. Acceptable Use Policy (Anti-Spam)
We have zero tolerance for spam. The Service is designed primarily for transactional communications (e.g., password resets, order confirmations, welcome emails).
You strictly agree NOT to:
Send unsolicited bulk marketing emails (spam).Use purchased, rented, or third-party scraped email lists.
Send content that is illegal, harmful, threatening, abusive, or defamatory.
Send messages that violate the CAN-SPAM Act, GDPR, or other applicable communications laws.
Violation of this section will result in immediate account suspension without refund.
4. Account & DNS Responsibilities
DNS Verification: You are responsible for adding the required DNS records (SPF, DKIM, CNAME) to your domain registrar. Failure to verify domains may result in low delivery rates or blocking by receiving mail servers.
Security: You are responsible for keeping your API keys and account credentials secure. Any activity performed using your API credentials will be deemed your responsibility.
5. SMS Services
US Availability: Currently, SMS functionality is provisioned for US numbers. You agree to comply with all US carrier regulations (including A2P 10DLC requirements where applicable).
Consent: You warrant that you have obtained explicit consent ("opt-in") from all SMS recipients prior to sending messages.
6. Intellectual Property & Content
Your Content: You retain ownership of the email templates, text, and recipient data you upload to the Service. You grant us a worldwide, royalty-free license to use, reproduce, and modify this content solely for the purpose of delivering your messages and formatting them for display (e.g., rendering variables).
Our Platform: The MailGantry interface, API structure, code, and documentation remain the property of The SaaSy People Ltd.
7. Fees and Payment
Fees are charged based on the volume of emails/SMS sent or your subscription tier.
We reserve the right to change our pricing upon notice.
You are responsible for all taxes and carrier fees (for SMS) associated with your usage.
8. Limitation of Liability
The Service is provided "AS IS." The SaaSy People Ltd. shall not be liable for:
Emails or SMS messages blocked by recipient filters, firewalls, or carrier networks.
Delays in delivery caused by third-party upstream providers (e.g., Amazon AWS, Telecom carriers).Any indirect, incidental, or consequential damages arising from your use of the Service.
Our total liability to you for any claim arising out of these Terms shall not exceed the amount you paid us for the Service in the six (6) months prior to the claim.
9. Termination
We may terminate or suspend your account immediately if:
You breach these Terms (specifically the Anti-Spam policy).
Your bounce rates or spam complaint rates exceed industry-standard thresholds, risking the reputation of our sending IP addresses.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales.
