By installing or using the Just Wishlist application (the "Service") provided by The SaaSy People Ltd. ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not install or use the Service.
2. Description of Service
Just Wishlist is a Shopify application that enables merchants to offer "save for later" and wishlist functionality to their store visitors. Key features include:Creation and management of customer wishlists.Support for multiple wishlist collections (e.g., specific occasions).Integration with Shopify themes to display wishlist icons.Basic analytics regarding popular wishlisted items.
3. "Built for Shopify" Architecture
You acknowledge that the Service is designed as a "Built for Shopify" application. This means:
No External Storage: We do not host a separate database for your customers' wishlist data. All data is stored natively within your Shopify store (using Metafields) or the user's browser (Local Storage).
Performance: The Service relies on the Shopify platform's infrastructure. We are not responsible for performance issues related to Shopify's own API latency or downtime.
4. Merchant Responsibilities
As the store owner (Merchant) using this Service, you are responsible for:
Theme Compatibility: While we strive for automatic integration, you acknowledge that custom themes or third-party code may require manual adjustment to work with the Service.
Data Management: Since data is stored in your shop's Metafields, you retain ownership and control of this data. You are responsible for managing this data in compliance with your own store's privacy policy.
Customer Consent: Ensuring you have the necessary consents from your shoppers to store their wishlist preferences, particularly if you operate in regions with strict cookie/local storage laws (e.g., EU/UK).
5. Intellectual Property
Our Rights: The Service, including its code structure, design elements, and algorithms, remains the intellectual property of The SaaSy People Ltd.
Your Rights: You retain full ownership of your store data, customer data, and the content of the wishlists generated within your store.
6. Billing and Payments
Fees for the Service (if applicable) are handled directly through the Shopify Billing API.We do not process payments or store credit card information.Billing disputes must be resolved in accordance with Shopify’s billing policies.Uninstalling the application will cancel the subscription at the end of the current billing cycle, as per Shopify's standard terms.
7. Limitation of Liability
To the maximum extent permitted by law, The SaaSy People Ltd. shall not be liable for:
Any indirect, incidental, or consequential damages (including loss of sales, data, or goodwill).
Issues arising from Shopify platform outages or updates to the Shopify API that temporarily break functionality.
Conflicts with other third-party apps installed on your store.Because the Service runs within your Shopify environment, our total liability for any claims related to the Service is limited to the amount you paid us for the Service in the three (3) months prior to the claim.
8. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis.
We do not warrant that:
The Service will meet your specific requirements.
The Service will be uninterrupted, timely, secure, or error-free.
Any errors in the Service will be corrected immediately, though we strive to maintain high standards of support.
9. Termination
By You: You may terminate these Terms at any time by uninstalling the Just Wishlist application from your Shopify store.
By Us: We reserve the right to terminate or suspend your access to the Service if you violate these Terms or if we discontinue the Service.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. You agree to submit to the exclusive jurisdiction of the courts located in England for the resolution of any disputes.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes via the email address associated with your Shopify store or through a notification within the app dashboard.
